Two types of matter
The process differs for an executive and for a specialist sent to a project.
Documents for the head of a Russian company with Chinese participation, or of an accredited branch or representative office, are arranged together with the appointment decision. The following are determined: the documents needed to work in the position, the sequence of the appointment and the permit procedures, the company's obligations as employer and the procedure for a head who is not permanently in Russia.
Technical managers, engineers and other key specialists are sent to launch production and to carry out commissioning, quality control and technology transfer. The following are determined: the immigration status according to the duration of the work and the travel schedule, how the relationship with the Russian company is documented and the allocation of responsibilities between the head office and the Russian company.
China-specific considerations
- Documents executed in ChinaDocuments on education, qualifications and experience and the company's constituent documents are apostilled and translated. The list of these documents is determined at the outset and included in the overall schedule.
- Coordination with business travelThe timing of procedures is aligned with the travel plan: some steps are taken outside Russia and some after entry, and breaking the sequence leads to repeat procedures.
- Working in two countriesFor an employee who keeps a position in the Chinese company, the documentation of the relationship with the Russian company, the allocation of duties between the companies and the consequences of combining the roles, including tax consequences, are determined.
- Language and instructions for the employeeDocuments for the employee are prepared in two languages, and the steps are described one by one, including the documents the employee submits in person and the first days after entry.
